In March 28th, 2019 in Broward County Florida, (Case # FMCE 09000250 (36)(91) Judge Peter Holden after doing his research on the Illinois case # 09F143, he denied the mother's petition to registered the Illinois custody decrees, also asking the mother in open court if she had left Illinois to Washington state without a leave of court and the mother response was “yes”, he was also asked if she changed the child’s name illegally, and the mother answer was “yes” not only the petition was denied but, it was also stated on the court order that “the state of Illinois has continuing and exclusive jurisdiction of the parties, the child and these matters”

In March 28th, 2019 in Broward County Florida, (Case # FMCE 09000250 (36)(91) Judge Peter Holden after doing research and finding the facts on the case, he denied the mother’s petition to register in Florida the Illinois custody decrees case (# 09F143) and her request for an DVOP she filed simultaneously.

Also during the same hearing judge Holden, asked the mother in open court if she had left Illinois to Washington state without a leave of court and the mother response was “yes”, she was also asked if she changed the child’s name illegally, and the mother’s answer was “yes” not only the petition was denied but, it was also ratified on the court order in writing that “the state of Illinois has continuing and exclusive jurisdiction of the parties, the child and these matters”

The mother has been denied multiple DVPO in 3 states while forum shopping over the last 5 years.

The mother has been issued Civic Arrest Warrant in Illinois for refusing to comply with multiple Judges orders

The mother has squandered (kidnapped) with the child and hid herself and the child for over 4 1/2 years.

Law enforcement found out that Michelle committed forgery with the help of her mother by soliciting a Delayed Birth Certificate from the State of Indiana and through it, changed the child’s name and his social security number without the father’s knowledge.

Due to this forgery, there is ongoing document forgery criminal investigation by Washington Issaquah Police department. Report Case number: 17-02552 Sergeant. Ryan Raulerson.

Sanctions has been issued against the mother in Washington and Illinois for bringing up merit-less litigation and false claims against the father and the courts, and she has been found guilty of filing litigation in bad faith.

The mother has filed at least six false abuse report with DCF with the intention to harass the father and with false allegations against the father, all those reports have been closed and determined to be unfounded.

The mother has committed fraud with the help of council against the Florida court by filing a pick-up order using a previously adjudicated and dismissed DVOP injunction in the state of Washington.

The mother has filed multiple requests of orders of protections injunctions with false testimony.

The guarding ad litem Mr. Thomas Kenny and the therapist Mr. Mark Goldstein, who were assigned to this case by the Illinois court and handpicked by the mother, testified that the mother deceived them multiple times and Illinois Judge has gone as far as to sanctioning her, for such behavior.

The mother has admitted in open court that she has secreted the child and that she left Illinois, without leave of court or informing the father or her own attorney, in the middle of a reunification plan and that she through fraud obtained a false delayed birth certificate in Indiana for the child, through which she changed the child’s name and social security number and used it to register the child in school in Issaquah Washington where she had fled to.

Even though, the Illinois court issued a visitation order on 11/07/2017 for the mother, with certain conditions to see the child under supervision, the mother has refused to comply with that court order and has tried to circumvent the Illinois visitation order, multiple times, by filing other meritless pleadings in various Florida courts.

The mother has not paid any child support since physical custody was transferred to the father on Jan. 2017.
Timeline of Events
April 20, 2015

The mother requested a permanent Domestic Violence Protection Order in the DuPage County court proceeding, which was denied after a full hearing in which both parties were present and arguments were presented to the court.

The mother was ordered to work with the father on a reunification plan.

Guardian ad litem, Mr. Thomas Kenny, and a therapist, Mr. Mark Goldstein, were assigned by the Illinois court to assist in the reunification process. The mother was given 1 year to go through the process and she refused to fully cooperate with the guardian ad litem and the therapist.

July–December 2015

The mother missed 3 different court hearings and disappeared from the state of Illinois sometime between July and November 2015.

She obtained a new birth certificate for the child through forgery from the health department of Indiana claiming the child was born in Indiana through the services of a midwife. The child was born in West Palm Beach, Florida at Wellington Regional Hospital.

After obtaining this fake birth certificate, she then enrolled the child in school under an alias and assumed an alias herself. She has not provided this alias to the court.

There is an ongoing forgery investigation on the mother for the use of the false birth certificate by Issaquah, Washington PD. (Case #: 1702552)

Judge Else of Illinois issued a warrant for the arrest of the mother and a civil contempt order. case # 09F143

February 29, 2016

The father requested for the court to transfer custody to him and relocation to the child and those motions were granted by Judge Else. under court order case # 09F143.

March 18, 2016

Illinois, DuPage County judge Thomas Else issued a clarification to the 02/29/2016 order case # 09F143, requesting that any law enforcement agency shall locate and take possession of the child and transfer him to the father.

The father filed a missing child report (SO16018080) with the DuPage Sheriff Department.

January 27, 2017

The child was found in Issaquah, Washington by the Bellevue Police department see Police Report #, who worked with the Illinois DuPage Country Sheriff ’s office to locate the child after the father filed a missing child report 18 months prior.

After the mother ex-parte, requested and obtained with false information a temporary DVOP in the state of Washington protecting her and the child.

The mother purposely gave false information about the child being removed from her care in Washington by police and used that order to continue acting in bad faith, in Florida.

After obtaining the ex-parte order from Washington, the mother came to Florida and obtained a pick-up order from a Miami Judge that did not even heard the father's side of the story, for the sake of the child, and with the assistance of the Miami Police Dept, the child was forcefully removed from the father’s home and the mom went back to Washington.

When the Washington King County court heard arguments from both parties Case No. 17-2-0198-0 KNT, it removed the child from the temporary DVOP then, ordered the mother to return the child back to the father and declined to exercise emergency jurisdiction over the child and father, and issued sanctions to the mother for filing petitions in bad faith.

A conference was held between the Washington and Illinois courts after the mother requested that the Washington court review their decision about jurisdiction. Then the Illinois court “expressly reserved and retained its exclusive and continuing jurisdiction over the parties.” Illinois stated its’ desire to retain jurisdiction and did not find that Washington State was a more appropriate forum.

Washington Judge denied the mother's request for an order of protection against the father case # 17-2-01981-0 KNT. The judge also issued sanctions against the mother for filing merit-less pleadings, with intentions to delay and frustrate the enforcement of the lawful orders issued by Illinois in favor of the father granting him custody of the child and permission to relocate him to Florida.

The mother committed fraud against the Florida court by using court order # (17-8-010981-0 KNT) which had already been dismissed in Washington on May 23rd 2017. She used the same dismissed order to ask a Florida judge to issue another pick-up order.

The mother also filed another DVOP against the father in Florida, restricting him from having contact with the child or herself, in another attempt to frustrate the orders of the Illinois and Washington courts. The only difference on this pick-up order was that the Florida judge would not allow the mother to take the child out of Broward and Miami-Dade county. Yet the mother took the Child to Orlando Florida which was against the recommendations of the court order.

Illinois court had a hearing scheduled for June 19 to handle the remaining issues of the custody of the child. The mother withdraws her petition without prejudice.
June 20th, 2017

The mother after keeping the child away from the father from May 30th until June 20th and not allowing any type of communication with the father and child at all, the Florida Unify Family Court of Miami-Dade held in front of Judge Marcia Caballero, an extensive evidentiary hearing on the mother’s motion requesting for a permanent injunction against the father, for her and the child, the Judge denied all mother’s requests and left pending, the issuing of sanctions against the mother, and only suggesting supervised visitation once per week for 12 weeks, which the mother then requested to be vacated for lack of jurisdiction. The judge before issuing her order confirmed with DCF that the mother allegation of child abuse had been unfounded and that there were not concerns about the child returning to go back with the father who has had legal full custody for purposes of all state and federal statues since 2016.

The circuit court of the seventeenth Judicial circuit of Broward County had a hearing where the mother had requested a DV Injunction against the father Case # (19-000110) the judge assigned to this case was Judge Greenhawt, who dismissed the mother request due to insufficient evidence.
